Hi, yes mere postings are similar – all sellers are required to complete a Property Condition Disclosure Statement (PCDS). If the owner knows there has been drug related activities carried on in the property they are required to disclose it. However, if they do not disclose it there is still no liability that passes to the listing REALTOR whether in the case of a mere posting or in a full service contract. The PCDS is a disclosure provided by the owner. It is not influenced by any real estate licensee and no licensee has any liability for what the PCDS says. So no guarantee is provided or should be perceived.
